The Latest Changes Announced for Spousal Open Work Permits.
Starting January 21, 2025, the rules for Spousal Open Work Permits (OWPs) are changing yet again.
Let’s break it down:
1. Spouses of International Students
Your spouse must be enrolled in one of the following programs:
- A master’s program that is at least 16 months long,
- A doctoral (PhD) program, OR
- A select professional or eligible program (you can find the lis of eligible programs here: https://www.canada.ca/en/immigration-refugees-citizenship/services/study-canada/work/help-your-spouse-common-law-partner-work-canada.html)
2. Spouses of Foreign Workers
Your spouse must:
- Be working in a TEER 0 or 1 occupation, OR
- Be working in select TEER 2 or 3 occupations tied to labor shortages or government priorities.
👉 Important: The final list of these occupations will be published on January 21, 2025. All we know at this time is that the sectors include Natural and applied sciences, construction, healthcare, and others.
- The foreign worker must have at least 16 months left on their work permit when you apply.
Key Changes to Note
- No More OWPs for Dependent Children:
Unfortunately, dependent children of foreign workers are no longer eligible for OWPs. - Renewals Are Still Possible:
If you already have an OWP or need to renew it, you can apply as long as:- You’re applying under the same criteria as your current permit.
- The renewal duration matches the study or work permit of your spouse.
- Exceptions to the Rule.
- If your spouse is a worker covered by a free-trade agreement or transitioning to permanent residence, these changes don’t apply to you.
- If you no longer qualify for a family OWP, don’t worry! You can explore other work permits that might suit your situation.
